That was also discussed as a solution but here is why we said no to that one:
In one scenario the SEC requested all e-mails from 7 individuals relating to insider trading from a specific period of 7 days. Now if we utilized the Back-up scenario we would have had to do 3 different restores (because the users were spread across 3 different sites and then exmerge the data into 7 different PST's....but what if we have some smart users here and not only did they delete the message but the removed it from the deleted items retention? A backup won't catch that.....Not so far fetched.
