Actually, the 4xx error is correct, as this is a recoverable error, and its being generated by his MTA not the remote one.
He's resolving an MX record but failing to connect to any of the named mail exchangers at that time. Per RFC2821, 4yz replies are appropriate in cases where a retry of the same command, with no change to the sender or receiver, could result in success.
