All gratuitous legal advice is given on the honor system.  You are expected to 
donate $10 to your favorite theater (by going, for example) or to the synagogue 
on Maroseika (or your favorite house of worship).

OK.

1.  The new rule is 90 out of every 180 days.  Or 180 or 360.  Which 
incidentally will prevent folks affected by this rule from having RF as a tax 
domicile.  So before if you had a commercial visa, and spent 183+3 days (as I 
dimly recall) in Russia, and registered, you could claim 13% tax, now... not so 
much, as you can't legally have 183+3.  One, I guess, could stay illegally, and 
pay the fine and then have the tax residency, but if you get audited, the 
question of whether residence obtained in violation of local residence laws 
counts is... interesting, my gut feeling, yes.  I digress.

2.  The available commentary and literature does NOT show that this is 
retroactive.  The new rules were published (rossiiskaya gazeta) on October 4, 
so the magic date is January 4.  Historically, it is unlikely that this sort of 
thing would be implemented prior to start of next year.

And even then, it is somewhat uncertain, as there is some discussion as to 
specifically WHERE the dates are to be market (the little white OVIR blank), 
but then you hand this in every time you travel... stamped on the visa, but in 
which space.  

One of the truly joyous thoughts is what the attempt to enforce this will do to 
passport control?  Three hour lines at SVO2?  Going in or out?  The amount of 
fine has not been published.  Ad nauseum.

So, if you have the wherewithal, the current advice is to get and register a 
work visa.  There is a kind of concensus, largely coming out of the big mustard 
colored building on Sadovaya near New Arbat that they will be exempted, there 
is no legal authority for that, currently, other than that if Russia's 
intention is sincerely aimed at reciprocity, there is no "90 days and out" rule 
for people legally employed in the U.S. or EU.

But, basically, it is not entirely thought through and has a decent chance of 
not being entirely thought through until it is implemented.
