Only if it can be proved that they knew about criminal activity on Foley's part and didn't report it. So far, there's no evidence to that effect. If none turns up, they're *legally* in the clear. But it's still a GIGANTIC ethical scandal. Even some Republicans are calling for Hastert's and Boehner's and Reynolds's resignations. They did know Foley was a loose cannon, page-wise.
