Hi everybody, Thought Equity was easier other years to be honest.
I have been looking up the Hastings v Bass for curiosity. I know its so bad to do post-mortems!!!! But here goes Hastings v Bass is a principle which emerged that a court would hold a trustee's bona fide exercise of discretion to be void if it is clear that he would not have acted as he did: (a) had he not taken into account considerations which he ought not to have taken into account; or (b) had he not failed to take into account considerations which he ought to have taken into account.
