Agreed.  Even if it's an "outdoor" dog, it's usually required by law to have a shelter of some kind for the animal to get out of the elements.
 
I'd call the local humane society if the dog is still outside at bedtime.

Well, if the dog is out there all the time, it's not right at all. You
might check at 8pm. Even if not, the dog needs a shelter when
outside.  Some places have a law against leaving dogs tied outside.
