I find the same behavior as you do -- using the normal selection method the radio button for measure attached is highlighted, even when the cursor indicates it should be a note-attached expression.

However, once you change the radio button to Note Expression once, each subsequent use of the palette will follow the cursor (if the cursor indicates measure attached, the note-attached radio button is grayed out, if the cursor indicates note-attached then the correct radio button is selected.)

Having made that selection once, subsequently closing and reopening the program leaves the note/measure expression radio buttons following the cursor type.

So it is just a minor annoyance easily resolved and not a real bug.
