IANAL, but the GPL says (section 3) if you distribute (and optionally 
charge for) a binary, you must include the GPL text and you must either

- include the sources (all the stuff you used to make the binary,
   including compilation control scripts, interface files, patches,
   etc., but excluding parts belonging to the host system)

- include a written offer, valid for three 3 years minimum, to
   provide all the sources on demand to any third party at cost

So before we can say GPL violation, we need to see exactly what's on 
their CD and how it's packaged. Someone has to buy one :-)
