... ultimately I don't think it matters since the sylphhed I would consider 
safe to include as binary in Fink distribution (if it is considered at some 
point obviously) would be the sll disabled version. That's purely because of 
what I use as source code for the respective versions.

In the sylpheed COPYING file I see the following:

 Specific permission is granted for the GPLed code in this distribition to
 be linked to OpenSSL without invoking GPL clause 2(b).

So it seems they are aware of the problem and have solved it, according to google already several years ago. This package should not be restrictive.
