well there are two solutions to this, one I could disable the patch and then ppl wouldn't answer the question that would change the Darwin libnet.cfg (which I thought was BAD) the other is ppl with proxys or unstable inet connection need to go offline. those are the choices. it's not a bug. just a choice really and fink editting the system libnet.cfg I thought would be a bug.
