  That is apparently what did happen - but the current story is that it
was even a worse mess.

  Apparently there was *no* evidence of an armed suspect - the deputy
who was the lead "dynamic entry" person heard the blow of the battering
ram wielded by the officer in front of him, mistook it for gunfire
coming from inside the house and then fired multiple times through the
closed front door.

  Then to continue this messed up case, the Grand Jury returned an
indictment of murder, 2nd - but the next day the foreman said he
accidently checked the wrong box!  Apparently the indictment has been
voided, and the DA intends to present charges to a new Grand Jury.

  These new developments seem, to me, to end the discussion of whether
there was sufficient evidence to open fire and the suspect.  Rather this
seems to be a much simpler case of accidental or negligent shooting,
which is a quite a different situation.
