There is also a little matter of the lack of constitutional authority for the union government to prohibit anything on state territory except its own proprietary assets. The power to regulate is not the power to prohibit, and  commerce properly includes only the transfer of title and possession of tangible commodities from a seller outside a state to a purchaser inside it. The Commerce and Necessary and Proper clauses were not intended to confer general police powers.

I have begun assembling a list of draft  constitutional amendments, most of which merely clarify and do not make substantive modifications.
