If you include a claim based upon a theory of fraud, many jurisdictions will allow 3x damages, and/or punitive damages and/or attorney fees. Unless you are under contractual terms to the contrary, you should be able to file in your county of residence and let him defend himself on your turf. Once an action like that is offered or actually filed, he may become more interested in making it right. It will cost him a bunch less time, money, energy and worry to make it right without a protracted legal battle, especially if he is facing treble damages and your attorney fees in addition to his own costs. 9K$ is not a trivial amount at my house. I would at least have an initial consultation and see what the options are.
Going after this guy might have two desirable consequences: 1) You get either the engine you bargained for or your $ back, and 2) He may think twice before he cuts corners on somebody else's engine.
