If there is documentation proving charges for work never done, that would set the tone for litigation that follows. That would piss off any judge... shop looses for fraudulent conduct. But it's also important to show negligence oand the failure mode for the motor, rather than some sort of latent defect in the parts delivered to the shop for repair. One would have to show that a capable machine shop doing this work by normal standards would not have turned out the same sad result. I don't think the lack of in-house capability to sleeve one bad cylinder out of eight excuses ruining the engine boring all of the remaining cylinders to spec limits. I think at best, it was negligent advice if this block is difficult or impossible to replace. Much will depend on written contract (receipts) and documentation plus a failure report from an independant shop. But with that documentation in place, you can win this with eyes closed in small claims court and without an attorney. This is too much money to walk away from, IMHO. But then I wasn't there when the deal was made. At worst, you recover charges for all work billed but not performed. At best, you can have the replacement engine paided for with an identical build from another more capable shop.
