This has already been discussed on the linux-kernel list.
My understanding from emails by Alan Cox is that the code was substantially
revised for the 2.2 series. His belief seems to be that there is no such
problem in the current kernel. If you do find such a problem, I know that
the developers will welcome any additional information.
This is still an ongoing concern for the 2.0 series however. I don't know
how much of this (if any) is being addressed in the 2.0.37 kernel still in
testing. (I've been too lazy to keep up with the continuing 2.0 kernel
development.)
