Theoretically, that's the case. But in reality it's just naive. Lots of
people break their TOS agreements on a daily basis. As an example, do you
know anyone that has a MediaOne account that runs some sort of server on
their machine? I'd guess you almost must. Well, guess what, MediaOne
says you can't do that.
Technically, when you access that server, you are intruding on mediaone,
since they don't allow the service. Fortunately, MediaOne only shuts off
the service of their user. But if the laws worked the way some people
suggest on this list there really isn't anything stopping them from going
after the user on the other end, other than common sense.
