By now(Monday morning) this is probably a me too.

The plain truth is, the company must back your policy.

If your policy is written in such a way that does not include
terminating such employees, then maybe it's time to
change it. If your company is unwilling to execute(pun
intended) your termination claus, then the policy is useless.
