Ah, good point. I just got excited when I saw that variable in there. It is
one step closer to abstract.

I think they're following the Java language closely, which only has public
constructors.

Java does support private constructors. Using a private constructor is
the standard way of creating Singletons in Java just like in AS2. Java
also does support abstract classes which neither AS2 or AS3 do. There
are some ways to get around this limitation in AS though, but all are
pretty much hacks, and the limitation makes it tougher to read the
code and to understand the true intention of the programmer. I would
love to lobby Adobe to add abstract classes and private constructors
to the future version of AS. It does seem silly not to support this
stuff.
