http://forum.civicrm.org/index.php/topic,5360.0.html basically, we made those decisions 3 years ago when we were less informed / educated / knowledgeable about the process. We did not know whether CiviCRM would take off and be successful etc (we are quite amazed and blown away by how far it has come) yes, requiring folks to license away their work away as AFL, while we are AGPL does not seem right nor fair (IMO). We are happy to conform to the standards and will do so in the future (with a standard copyright assignment / CLA etc). However so far we have not recd any major contributions to core, and the urgency to do so is not very high (IMO). Getting the legal structures in place etc is also a fair amount of work. If this is a stumbling block to any of your organizations, we'd be happy to discuss this and agree on a timeline when this can/will be done.
