This is a clarification on tonight's discussion on the Earth Fill & Removal Bylaw.

As part of our administrative agenda the Board will be discussing the draft of the bylaw which is still in the formative stage. With input from the board members, Karen Margolis, our zoning specialist, will modify the draft and then at a subsequent meeting, when the board is satisfied that the draft is at an acceptable stage, we will vote to sponsor (or co-sponsor) the bylaw article. At that time, we may also consider holding a public hearing to solicit input from the public where further modifications may be suggested. Because this is a "bylaw" and not a "zoning bylaw," there is no statutory requirement for the Planning Board to hold a public hearing. However, we may choose to do so, and I believe the PB would support that since the issue has generated much public interest. At the close of a public hearing, the board would vote on supporting the bylaw in its final form at a Town Meeting. Although tonight's discussion is not a "public hearing," it is an agenda item of a public meeting and there will be an opportunity for the public to ask questions and make comments. The Board will not take any votes tonight as a courtesy to one board member who is out of state on business.
