Despite all the arguments you brought up for it not being a known issue, the
fact of the matter is that to a lay person it was. When there's news reports
on the issue it certainly is a "known issue". If they had declined to
comment, or said that they hadn't determined whether it was a design flaw or
not then they wouldn't be in the position of having lied, and made some
customers very unhappy with the issue.

Wait a second, anytime something is reported it is therefore substantiated? Your logic is way beyond faulty on this one. Apple said they were not aware of an issue, that has not been proven false. Its like me saying I am dating your sister, its not true simply because I said it. Nor is it true when someone writes it on their blog, or when Ted Copple reports on the blog. Many news sources only cited the petition site as a source, not exactly pure research.

To the lay person does not make it real. A perceived issue is an issue for PR, and Apple followed their PR policy, no comment, no acknowledgment until they have it figured out. Sometimes it helps them, sometimes it hurts them, but its consistent.

By bouncing from whether the problem was real and what Apple knew [and when they knew it] to a customer's perception you are changing the topic entirely. Pick one. While they are linked they are not interchangeable.
