What happens when you goto Terminal and type
mv -f ./FILENAME ~/.Trash
But can you delete it out of the trash once it is there??
If not regular delete, try secure delete.
If not, try moving it to /tmp which is (I think) automatically cleaned out during the boot process, when no other process can "claim" the file is in use.
