if that's the case then there probably isn't much to be done about it,
other than to know the parties involved in the transfer are probably
scum and hope that the karmic wheel finds them and runs them over soon. 
in any case, if the new owners don't make use of it the original owner
can get it back, and there are several other ways to get a domain back
or get it in the first place.  if people simply forgot to pay the rent
then they do need to be more attentive.
