if you don't have a lawful purpose, and come on to my privacy and snoop,
even if you don't break in it may not be illegal, but it's obnoxious. 
if you do that to my house you should expect to be looking at a shotgun
and asked to explain what the hell you're doing snooping on me.  of
course coming to the front door and knocking is ok, or walking by and
noticing things, but active snooping on my property strongly suggest a
criminal intent, whether or not you break in at that time.  obviously
the utility companies also have some legitimate need to come on to my
property, to read meters, but if they press their face up against the
window to see inside they are violating my privacy.  you do have a right
to expect people not to go out of their way, even as far as peeking in
windows, to spy on you.  it's obnoxious and intrusive and none of their
business.  passers by may look at the windows from the street or
sidewalk, but if they get any closer they'd best have a legitimate
reason to be their, if they start checking to see if a window or door is
locked, they are clearly planning a break in.  if you a mearly casing
the place as it were, it suggest you plan to break in later.  trying to
see if a machine is at an address is ok i suppose, but thorough probing
of it suggest you're interested in more than finding a willing server. 
it's ok to try and open an http or ftp access, but most other ports
should be left alone.
