it could very well be true.  as i recall, the pentiums 3 was actually
slower than the pentium 2 at the same clock rate, some computer
journalist suspected as much and deliberately underclocked a p3 to the
same clock speed as a p2, and p3 was indeed slower than the p2 at the
same clock rate!  i hadn't heard about any law suits, i'm not sure what
the basis would be other than someone claiming the p4 was "better" or
"faster" than the p3, although it seems likely such claims would be made
by intel and pc makers.  like i said, the x86 architecture has been
pushed too far and the newer pentiums are seriously hurt by the need to
be backwards compatible with the older chips.  the backwards
compatibility makes some architectural changes nearly impossible,
introduces major overhead for others, and likely totally neutralizes
some improvements with code that has some of the "old" instructions in
it, which are hard to weed out of mature applications like the os and
many apps, or if older versions are run.

then again, most mac software still hasn't been recompiled to take
advantage of all of the altivec units which potentially make many apps
much faster.  photoshop has of course been updated, but allot of other
apps haven't been.
