First, make sure you're not confusing a true scan (or probe) with
just normal ARP traffic.
Good ISP's perform several types of scans. This keeps their network
free of fleas and other bandwidth sucking annoyances. Other ISP's,
the ones that like to keep their legal heads in the sand, do nothing.
ISPs under a UDP (USENET Death Penalty) scan their customer IPs
regularly for open nntp servers.
Scans for zombie (infected) PCs are always a Good Thing, IMO.
To enforce their AuP, some ISPs scan for unauthorized nntp, http,
irc, and p2p servers.
OTOH,...I regularly chat with a friend that works in a major cable
ISP's abuse department (we met during a hunt). Amazing the legal
hoops they have to jump through! They're NOT allowed to proactively
scan - that's a violation of a customer's privacy. When they receive
a *specific* complaint, they're permitted to perform a simple probe
to confirm the problem. They could then just flip a bit in the
customer's profile, effectively shutting them down (kill
permission-to-talk). But noooo... Instead they're required to phone
the customer *repeatedly* and send them several warnings in
writing... This keeps the flea on the network, continuing the abuse
for MONTHS before being shutoff. Very ungood, IMO. But this is what
they have to do as prevention from being sued... :\
