The term in loco parentis, Latin <http://en.wikipedia.org/wiki/Latin> for
"in the place of a parent" or "instead of a parent,"[1]
<http://en.wikipedia.org/wiki/Loco_parentis#cite_note-law.com-0> refers to
the legal responsibility of a person or organization to take on some of the
functions and responsibilities of a parent
<http://en.wikipedia.org/wiki/Parent> . Originally derived from British
common law <http://en.wikipedia.org/wiki/Common_law> , it is applied in two
separate areas of the law.

First, it allows institutions such as colleges and schools to act in the
best interests of the students <http://en.wikipedia.org/wiki/Student> as
they see fit, although not allowing what would be considered violations of
the students' civil liberties <http://en.wikipedia.org/wiki/Civil_liberties>
.[1] <http://en.wikipedia.org/wiki/Loco_parentis#cite_note-law.com-0>

Second, this doctrine can provide a non-biological parent to be given the
legal rights and responsibilities of a biological parent if they have held
themselves out as the parent. [2]
<http://en.wikipedia.org/wiki/Loco_parentis#cite_note-1>

The in loco parentis doctrine is distinct from the doctrine of parens
patriae, the psychological parent doctrine, and adoption.[3]
<http://en.wikipedia.org/wiki/Loco_parentis#cite_note-2> In the United
States, the parental liberty doctrine imposes constraints upon the operation
of the in loco parentis doctrine.[4]

Jerry,

Can you sum up just what in loco parentis means?

Question for our legal beagles:

Does in loco parentis apply to students over 18?

Just one (& only one) comment regarding the helmet law/edict/proposal that
UF is instituting/instigating/infuriating:

Did it ever occur to any of us (save me – of all?) that since a large
portion of students have recently left their parents’ direct supervision, UF
is extending the in loco parentis rule that covers elementary & secondary
education to the collegiate arena? It seems that how litigious society has
become, if UF at least implements the helmet rule, then parents would be
less liable to try to sue the university in the case that a severe accident
would happen to their child who happens to be out of their direct
supervision.

Just another point to ponder.

Geez. This phys. ed. teacher has entirely too much time on his hands! Let’s
see: Phys. ed. teachers’ conference in 2 weeks, coaching association
convention in 3 weeks, football practice in 6 weeks. That means school (for
me) starts in 7. Oh boy.
