Oh, very much so - that's pretty much the lesson from all the stuff  
we've been doing on ODBL for OSM.

And to be honest - if you think it's fuzzy in the US, you should see  
the situation over here. At least Feist vs Rural pretends to be  
unambiguous. The EU Database Directive, however, has been so heavily  
redefined by successive judgements (notably BHB vs William Hill) that  
AFAICT no-one quite knows what the hell it's meant to do any more.
