The Transboundary Protected Areas Research Initiative (TPARI), hosted by
the University of Johannesburg, South Africa and the International
Institute for Social Studies (ISS), Erasmus University Rotterdam, the
Netherlands, cordially invites you to attend the fifth teleseminar of the
2009-2010 teleseminar series addressing current research topics in
conservation and development in Southern Africa and beyond. The
teleseminar aims at promoting exchange of experiences and dissemination of
knowledge on current research themes by leading scholars and practitioners
in the field. The fifth teleseminar will take place on:

Presentation: Dr Derick A. Fay of the University of California, Riverside,
US will present a paper entitled: “The Unsettled Settlement: Conservation,
Tourism and Land Rights at Dwesa-Cwebe Nine Years after Land Restitution”.

Abstract

Discussions of the relationships between neoliberalism and conservation
have given scarce attention to ways the legal processes associated with
neoliberalisation may foster a turn to law and litigation as the vehicle
for political struggle. Drawing upon the Comaroffs’ analysis of “lawfare”
(2006), this paper argues that the legal constitution of communities, the
downsizing of the state, fragmentation of sovereignty and the formation of
heterogeneous networks of actors have contributed to a turn to the law as
the medium of relationships, conflicts and politics. Recent events at
Dwesa-Cwebe involving the community trust, tourism operators, conservation
authorities and local government illustrate how the neoliberal reliance on
law and legal forms may reconfigure the political ecology of conservation.
