I wouldnt go as far to say it is illegal. Youre making it sound like a
conspiracy. IPF has been shipped with OpenBSD for the past 5 years, and
Darren was tracking OpenBSD so he can fix bugs in his software, so nothing
was being done behind his back. He knew OpenBSD was shipping IPF with thier
system. His original license is here:

Notice the 4 magic words that are missing (and would make it very similar to
a BSD license) WITH OR WITHOUT MODIFYING. Granted, this was assumed by
OpenBSD all along, but since Darren never spoke up, no one saw it as a
problem. Im not sure if OpenBSD even modified the code (I know they added
hooks in their kernel for IPF), but the whole reason they took it out, is
because they want everyone to be able to do _anything_ with their OS, and
since Darren's license doesnt allow this, they took it out.
