MUTATION – A never ending process (if not bribed) The other day, as per new ruling, we sworn in affidavit to say our landlord is not ST or SC. Please note: When you buy property from Landlords/ builders etc make sure they don’t belong to ST or SC (Scheduled Tribe or Scheduled Caste) bearing in mind some of our Ministers and MLAs (builders or landlords) belong to this category.
Advocate charged us Rs.250 for one page of Rs.20 stamp paper. We then went to Panjim Mamlatdar office to submit the same. He now says, We need to get a report from Talathi. Whose Talathi? Our Agxi Talathi or Landord’s Talathi? He said Landlord’s. He even says submit the affidavit to him. Well, we will now have to go to Margao to chase Talathi as our landlord is from Margao. Talathis never found at one place – They are often assigned with more than one office or village. Which means, we will have to make a minimum of 3 strips to Margao (don’t even know if Municipal area like Margao has talathi). We asked the Monkey, why you giving us hard time? Why it was not mentioned about the Talathi report in the same notice about the Afidavit (see copy )? The monkey had no answer. Our case is pending with them for nearly one year after newspaper publications. Otherwise, it completes more than 18 months. Property purchased 5 yrs ago And what’s the going rate for Mutation ? It’s Rs.20,000, it’s a scam Usually, paid in 3 or 4 instalments at various stages. They say there are agents who do this job City Lawyer-Govt. Babus nexus cannot be ruled out Modes operandi: When you visit lawyers for sale deeds etc, you will be advised to follow this route for a hassle free mutation. Mind you, this will still take around 3-4 months. And one Dy. Collector DK Redkar said last year that the whole mutation process can be disposed off in 2 days if all documents are in order. I am sure, when he said that, he did not know what he was talking about. Even Agnelo, another Dy. Collector once disposed of one case in 15 days for which he was suspended (read from archive below) Even if everything is in order, minimum days required would be 24 days (unless they bend the rules). Submit file with all doc in order, then after 2/3 days serve notices (Regd/AD) to sellers and other interested parties like tenants, nearby houses etc (if any). Wait for 2 weeks and then file is passed on to Circle officer who verifies and certify and then goes to Mamlatdar for final certification. Note: If all notices are not served or some or all come back undelivered, then add another minimum of 21days (news paper publication 14 days notice, affidavit, notices etc) Although the seller or the landlord gives NOC for mutation entry on sales deeds etc, notice are still served as per rules.
