If talking about open source software, depending on license even if  
source code of software itself is freely distributable original  
creator still owns copyright on the source code (MIT, BSD). I think it  
can also be seen as gentlemans agreement. If you use other peoples  
code, do not claim that part was made by you.

Of course, IANAL and nitpicking about licenses is boring :)
