Google don't make up traffic data, they buy it from a data provider. Data comes with terms of use attached to it. Offering data on the maps.google.com site is NOT the same as offering it to people to manipulate on their own webpage. Consequently Google have to (re) negotiate terms for traffic (or directions, or streetmap) data to be used in the API. They may or may not get approval at all from the data owner. It's not a technical issue, its a commercial one.
