Subject: It is alleged that Coercive circular by the Kerala government
to Public Education Department to deploy online school management
software called “Sampoorna” in schools across the State will violate
the right to privacy and dignity of children in Kerala

Sir/Madam,

I am directed to say that the National Commission for Protection of
Child Rights (NCPCR) has been constituted under the provisions of the
Commissions for Protection of Child Rights (CPCR) Act, 2005 for
protection of child rights and other related matters. One of the
functions assigned to the Commission under Section 13 (1)(j) of CPCR
Act is to inquire into complaints and suo motu cognizance in relation
to deprivation and violation of child rights.

2. The Commission has received a complaint (a copy of the complaint is
enclosed) dated 23/09/2011 from Kamayani Bali Mahabal , Usha
Ramanathan and Anivar A Aravind . The gist of the complaint /
allegation is as under:

"It is alleged that Coercive circular by the Kerala government to
Public Education Department to deploy online school management
software called “Sampoorna” in schools across the State will violate
the right to privacy and dignity of children in Kerala . This scheme
will give unique identification number to each student and will help
track their movements in educational institutions and academic
records. The complaints is self explanatory which may kindly be
perused."

3. After perusing the complaint, the Commission has taken cognizance
of the matter and directed that the matter be referred to you for
investigation/inquiry and report to the Commission.

4. You are accordingly requested to get the matter investigated and
take further necessary action. A factual report, along with
authenticated copies of the relevant documents, be sent to the
Commission within 15 days of issue of this letter. The Report should
indicate inter-alia the information on the following points :

Kindly look into the matter on priority basis and provide details with
respect to how your department plan to safeguard the children's right
to privacy and dignity in the use of UID/ Sampoorna Software.

5. In case, any other Commission duly constituted under any law, has
also taken up this matter with you or any other authority, a copy of
their communication may also be furnished.

6. Please quote the number and date of this letter mentioned at the
top while responding.
