We explicitly tell developers not to do it, and we add the programs that do (that we know about) to the Third-Party Installations page. There isn't anything else we can do about it. We haven't the resources to go around suing software companies, some of whom are very big (you might have noticed Adobe also on the Third-Party Installations page). Any attempts at a preemptive measure in Growl itself are non-starters because Growl is open source, which means that any application developer who intends to install Growl without your permission could install their own custom build of Growl. Dropbox does this in the current version. The main reason to make such a custom build would be to exclude whatever preemptive measures we come up with.
