That is correct. It's a standard open-source license.

Our license has to allow distribution of Growl software because the Growl
framework (which applications use to send notifications to Growl) is Growl
software. The Growl framework stays within each application. We don't condone
applications installing Growl itself without user permission, and we tell
application developers not to.

Just because somebody downloads our software and installs it on your system
doesn't mean they agree to or abide by our license, and we don't have the
resources to sue those who don't.
All we can do is tell application developers not to do it. We suggest you do
the same, once you find out what the guilty application is (and, again, we ask
you to tell us what it is, too).

Because you're running an old version of it. This is a common problem with
applications that install Growl: They install an old version of it.
You could simply update it, but since it sounds like you don't want Growl in
the first place, we'd rather help you uninstall it. That means finding out what
application is reinstalling it so you can remove it (since I assume you don't
want to use software that installs other software without your permission).

The Growl update notification has the Growl icon on it to identify it as having
