IANAL, but my impression is that it is ALWAYS a violation of copyright to obtain a PDF which someone else has scanned in, unless you're getting it from SJ Games themselves. SJ Games has the right to distribute their work (or, more generally, set conditions on the circumstances under which it is distributed); other people do not. I *think*, though I'm not sure, that it's legal to make your own scan of your own book, but you can't distribute it. The analagous situation is that you're allowed to rip your own CDs, but you are not allowed to download MP3s even if you own the CD.
