Ever heard of Stark? It is a law designed to keep physicians from getting kickbacks from hospitals or from referring patients to facilities they own or have a share in. Well, because of this law, hospital could not give or give discounts for EMRs to doctors who admit patients to that hospital as it is a form of kick-back from the hospital. Well, one of Dr. Brailer's initiatives has been to eliminate the regulations prohibiting that. It isn't law yet, but it is coming. There was a news story about it just today. STARK CHOICES DHHS has proposed safe harbors that would allow hospitals and other entities to provide more funds to technology-hungry physicians. by Gregg Reisman Esq. and Peter Mancino Esq. The U.S. Department of Health and Human Services (DHHS) has released two sets of proposed regulations regarding electronic prescribing and electronic health records (EHRs). If finalized and adopted, these regulations will offer protections to hospitals and physician practices that donate EHR technology and related services to other providers. Although the technology is currently available, hospitals and other entities have been slow to provide EHR systems to their medical staff because of concerns surrounding fraud and abuse laws.
