I agree mainly with you, but I've noticed around a company (Epic Games) that in the first version (retail) is usually secured with SecuROM but after the first ublic update the CD check is gone. UT was that way, ut2004 is that way, unreal 2 the awakening is cracked for no CD, though I own all those games, and personally, under the legislation in my country, I can do whatever I want with a product that I bought. From the moment I bought it, it's mine to do whatever I decide with it, and the EULA has not much weight in court of law.
From a funny one, try buying a laptop with windows installed, refuse the EULA, go to court of law and demand the refund of the OS money you payed but you can't use, because you don't agree with the licence ;) After a small battle you might find interesting that you can pull back the retail costs of the OS instead of the lame 10€ they wanna pay... At least worked in 3 countries already.

On a list of 25-100+ emails per day, with most being BS junk, it's easy to miss this one. Regardless, that was a pretty lame item in the agreement and it only serves to make Vivendi look bad. I mean, these CD-Required games usually get a work-around hacked EXE released out there anyway. Sure, it may break the EULA, but at least it allows legal game owners to play without the annoying CD check.
