Ok, here is my take on it....

I'm going to buy a new Ford pickem up truck.  You tell me, "Hey, I had one
of those trucks recently, let me tell you about it."  You then proceed to
inform me about all the problems you have had with the truck (on a public
forum). I publicly state that because of your experiences, I decided not
to buy it.  Ethical? Sure. You are telling me YOUR experiences with the
truck.  If Ford finds out, will they sue you? Probably. They will use
their legal muscle, even though you haven't done anything wrong by
expressing your opinion. They have money to pay for lots of lawyers,
you don't.

So, to avoid legal hassles, don't put anything in writing!  Even though
you are entitled to. Have people call you and you can give YOUR opinion
to them over the phone.  I know it sounds like the wimpy way out, but
that is our legal environment these days.  I've heard that VW is going
after people using Volks in a web page name. Why? Because they can.
Is it right, no.
