It's not a FLEX (Fundamental Software) issue, it;s an IBM issue.
zVM 5.x runs very well on FLEX-ES: there are numerous software developers
running it on FLEX-ES systems. However, so far IBM has refused to license
any 64 bit software on FLEX-ES for commercial/production use (this includes
zVM 5 and zOS 1.6 or 1.7). Developers who are members of IBM's PWD
program are allowed (even encouraged) to run 64 bit mode IBM software on
FLEX, but commercial customers who are willing to pay for it are not
allowed to do so.

Hi, Nob.
Since you can not order z/VM 4.x any longer from IBM, I would suggest
that you contact FLEX and see if you can not work out some sort of
agreement that would let you run z/VM 5.x on your FLEX-ES system. To the
best of my knowledge there is no technical reason why z/VM 5.1 would not
run, unless it has something to do with FLEX's support of VM in a 64 bit
environment.
