I will dispute that "LEM could theoretically be held liable". The site mentioned does not have any files, just links to APPLE'S OWN SITE. The same links appear on Google or any other search engine, and Apple hasn't tried to take them down. "Apple's rules" don't apply to anyone except Apple employees. However since proving that in court against Apple's lawyers would bankrupt a smaller company, let alone individual who tried to dispute the point, I don't blame Dan for not wanting to fight such a battle.
