Please be advised, this may have legal ramifications if you are a public
internet access provider. We have had subpoenas for copies of Email sent
through our system for various reasons, most recently a spousal murder case.
Our lawyers have advised us, since we are provide public internet access,
against ever keeping copies without a court order. As it is our sysadmin
was required to submit a deposition stating that we did not keep copies of
personal Emails and why.
According to the lawyers, if we were a private company then we could keep
copies as anything sent from or received by a user on a private network can
be held as company property. As a paid public provider we do not own any of
the data except that which originates or terminates in a company owned Email
account. They further stated that that was the North Carolina
interpretation of the law. In other states and countries it will of course
vary, and is subject to local interpretation
Just though this would be a good item to pass on. Please do not make a big
issue of it in the forum.
