Due diligence on the part of the ISP to inform users should go a long way to keeping you out of court, if not the full distance. Inform them in advance of installation, during testing and when testing ends, of whats going on. Solicit comment or objections. This is as much a customer service issue as it is anything else: keep your users aware you're adding value to your product.
