Scott: I respect Joe's right to a different opinion.
I have no respect for his inability to differentiate between two very different issues, coupled with his misrepresentation of the facts. Further, he has never responded to a question which was posted weeks ago asking him to explain the near 100% success record of MAPS in defending against the many lawsuits filed against them. MAPS has *never* lost a case where they could show direct origin of the spam and have only settled a handful of cases where the issue was the 'double-opt-in' requirement for mailing list management. If there is anything which shows the weakness of Joe's arguments here, it is MAPS track record in the courts. Similar examples can be shown regarding AOL and other major providers. I repeat: Joe is entitled to his opinion of this as a free speech and censorship issue. However, as a legal issue there is considerable case law which show his arguments to be unfounded. No court has *ever* ruled that any system must accept any and all mail sent to it. No court has ever ruled in favor of a plaintiff claiming loss of revenue due to a blocked email. These aren't opinions, they are facts.
