Possibly, I haven't played with the 'legacy' installer (the one included
in Solaris Express) in quite a while.  At one point it had an option to
preserve data in different slices, but with the addition of ZFS root
support to Solaris Express I don't know how that works these days.  My
guess would be 'probably not great' but as I said, I haven't played with
that installer in a very long time.

My recommendation would be, take a backup before you start.  In theory
if the zpools aren't part of the old 'root pool' then when you install
you can tell the installer what slice to install the 'root pool' on (I
believe) and that should spare the other slices (zpools) from being
touched.  You could then import those pools once your install is
completed.  Since I haven't tried this, it's merely a guess on my part
so take it for what it's worth.

One other possibility to your options that just occurred to me is if you
had a snapshot of your root pool from before your bfu.  You could
rollback to that snapshot and then in theory gain the ability to
liveupgrade.
