By that logic, the data connection is also charged and websites can continue loading stuff (via AJAX) in the background without the knowledge of user. Moreover, the sms link need not send the sms. It might just pre-compose the message and ask user to press the send button (same behavior as mailto: protocol). WinCE provides such functionality and J2ME also has an optional package for this.
