in KAME case we have kernel code which forbids the use of deprecated
address as a source (bind(2)) and FTP daemon cannot override it for
data connecdtion.
=> IMHO this is an implementation bug: deprecated != invalid.

PS: bind(2) should be the only common way to use a deprecated address
as a source address of a new "connection".
