Thank you for the calculations - it
is helpful but to date we have not received the revised circular from PTA
stating that we can deduct any costs (PTCL, licenced operators etc) from the
gross revenue so quite honestly unless the circular is issued all calculations
are meaningless.
PTA can legally close down any ISP's business
if we pay royalty at 1.5% of gross minus the charges you have shown in the
calculations.
I don't understand why PTA could not issue a simple
circular in almost ten days after they had met ISPAK and agreed to what you
have shown in your calculations, especially when they had given June 30 as the
deadline for clearing royalty dues.
So as of today June 24, 2001 we
have only two options:
1. Pay royalty at 1.5% of gross without any
deductions (and for years where the amount comes to less than 2.5 lacs we pay
2.5 lacs for that year - this is what our license says)
OR
2.
File a writ and hope to get the relief from the court.
Can you clarify
whether there is any other legal alternative available to ISP's other than 1
or 2 above.
What is the legal cover for the calculations you have
proposed in the absence of any circular from PTA for the
same?

Principally we agreed that there will be no royalty
on royalty. If you desire to deduct from turn-over / gross revenue the
charges paid to other operators may deduct at your risk if accepted then ok
other wise royalty on that amount you have to pay.
