IANAL but having the Apache header or not on files that contain public domain
text does not seem terribly important to me.
http://apache.org/legal/resolved.html has some info about this in the "Can
Works Placed In The Public Domain Be Included In Apache Products?" section.
If someone thinks there's an actual risk in doing things one way or the other,
asking legal-discuss for an opinion is fine, but I wouldn't let this block a
release. The probability of someone asking you to pull down a release based on
the presence or absence of these Apache headers looks extremely low to me.
